You may not use our products for illegal or unauthorised purposes or violate any applicable law when using the Service. You must not transmit malicious code. A breach of these Terms may result in immediate termination of Services.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse Service to anyone for any lawful reason at any time.

Your content, excluding payment card information, may be transferred unencrypted across networks and changed to meet technical requirements. Payment card information is encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, access to the Service, or website contact without our express written permission. Headings are for convenience and do not limit these Terms.

SECTION 3 — ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

Information on the Site is provided for general information. We do not guarantee that it is accurate, complete, or current. Any reliance on Site material is at your own risk. Historical information is provided for reference only. We may modify Site content at any time and you are responsible for monitoring changes.

SECTION 4 — MODIFICATIONS TO THE SERVICE AND PRICES

Product prices may change without notice. We may modify, suspend, or discontinue the Service, or any part of it, without notice. To the extent permitted by law, we are not liable for any modification, price change, suspension, or discontinuance.

SECTION 5 — PRODUCTS OR SERVICES

Certain products or Services may be available exclusively online and may have limited quantities. Returns and exchanges are governed by our Refund Policy.

We try to display product colours and images accurately but cannot guarantee that every display will reproduce colours accurately.

We may limit sales, quantities, geographic areas, or jurisdictions on a case-by-case basis. Product descriptions, availability, and prices may change without notice. We may discontinue products at any time. Offers are void where prohibited.

Nothing in these Terms excludes consumer guarantees or other rights that cannot be excluded under the Australian Consumer Law.

SECTION 6 — ACCURACY OF BILLING AND ACCOUNT INFORMATION

We may refuse, limit, or cancel orders, including orders using the same customer account, payment method, billing address, or shipping address. If we change or cancel an order, we may contact you using the information provided at checkout. We may limit orders that appear to be placed by unauthorised dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information and to update it as needed. See our Refund Policy for further details.

SECTION 7 — OPTIONAL TOOLS

We may provide access to third-party tools that we do not monitor or control. Such tools are provided “as is” and “as available,” without warranties or endorsement. Your use of optional third-party tools is at your own risk and subject to the relevant provider's terms. New Services or features offered through the Site are also subject to these Terms.

SECTION 8 — THIRD-PARTY LINKS

Some content, products, or Services may include third-party materials or links. We are not responsible for examining their content or accuracy and do not accept liability for third-party websites, materials, products, or Services. Review the third party's policies before completing a transaction. Direct complaints about third-party products to the relevant third party.

SECTION 9 — USER COMMENTS, FEEDBACK, AND SUBMISSIONS

If you submit ideas, proposals, feedback, or other materials (“comments”), you agree that we may edit, copy, publish, distribute, translate, and otherwise use them in any medium without restriction. We are not required to keep comments confidential, pay compensation, or respond.

We may monitor, edit, or remove content that we reasonably consider unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that infringes rights or violates these Terms.

Your comments must not violate any third-party right or contain unlawful, abusive, obscene, or malicious material. You must not mislead us or others about the origin of comments. You are responsible for your comments and their accuracy.

SECTION 10 — PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy.

SECTION 11 — ERRORS, INACCURACIES, AND OMISSIONS

Site or Service information may occasionally contain errors or omissions relating to descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct errors, update information, or cancel orders where information is inaccurate, including after an order is submitted, subject to applicable law.

SECTION 12 — PROHIBITED USES

You may not use the Site or its content to: engage in unlawful acts; solicit unlawful conduct; violate laws or regulations; infringe intellectual property; harass, abuse, harm, defame, intimidate, or discriminate; submit false information; transmit malicious code; collect others' personal information unlawfully; spam, phish, scrape, or interfere with security features; or engage in obscene or immoral activity. We may terminate access for prohibited use.

SECTION 13 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that results will always be accurate or reliable. The Service may be suspended or cancelled from time to time.

To the maximum extent permitted by law, the Service and products delivered through it are provided “as is” and “as available,” without warranties other than rights that cannot be excluded by law.

To the maximum extent permitted by law, AIMALL PTY LTD, trading as ToolsYard, and its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors are not liable for indirect, incidental, punitive, special, or consequential loss arising from your use of the Service or products. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

SECTION 14 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify AIMALL PTY LTD, trading as ToolsYard, and its related parties against third-party claims arising from your breach of these Terms, incorporated documents, applicable law, or third-party rights.

SECTION 15 — SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted and the unenforceable portion will be severed without affecting the remaining provisions.

SECTION 16 — TERMINATION

Obligations and liabilities incurred before termination survive termination. You may terminate these Terms by notifying us that you no longer wish to use the Services or by ceasing use of the Site. We may terminate or restrict access if you fail, or we reasonably suspect you have failed, to comply with these Terms.

SECTION 17 — ENTIRE AGREEMENT

These Terms and any policies or operating rules posted on the Site constitute the entire agreement between you and us concerning the Service and supersede earlier agreements and communications. Failure to enforce a right is not a waiver. Ambiguities will not be construed against the drafting party.

SECTION 18 — GOVERNING LAW

These Terms and agreements under which we provide Services are governed by the laws of Australia and the applicable laws of New South Wales.

SECTION 19 — CHANGES TO TERMS OF SERVICE

You can review the current Terms on this page. We may update them to reflect changes to our Services, business practices, or legal obligations. Where a change materially affects an existing order or ongoing contract, we will provide reasonable notice where practicable, and the change will not retrospectively reduce rights that cannot lawfully be limited. Existing orders remain subject to the terms that applied when the order was placed, except where a change is required by law or agreed with you.
